Terms of Service

These Terms constitute a legally binding agreement between you and Flomunis Inc. (“Flomunis”, “we”, “us”, “our”), a corporation incorporated in Ontario, Canada. By creating an account, completing verification, or using any feature of the platform, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy.

You may use Flomunis only if:

• You are at least 13 years of age
• Users between 13 and 17 must have obtained parental or guardian consent
• You are not prohibited from using the platform under applicable law
• Your account has not been previously suspended or terminated by Flomunis for a violation of these Terms

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, current, and complete information during registration and keep it up to date.

Flomunis uses a tiered verification model to build trust:

• Tier 1 (required for full access): email verification, phone number verification via SMS OTP, and agreement to the Community Standards and Code of Conduct
• Tier 2 (optional, unlocks high-trust features): government ID verification via Persona

Impersonating another person, providing false verification information, or using automated means to create accounts is strictly prohibited and may result in immediate termination.

You agree to use Flomunis only for lawful purposes and in accordance with these Terms. You must not:

• Post, share, or transmit content that is abusive, harassing, threatening, hateful, or discriminatory
• Bully, intimidate, or engage in targeted harassment of any user
• Use the platform for any fraudulent, deceptive, or illegal activity
• Scrape, crawl, or extract data from the platform without written permission
• Circumvent, disable, or interfere with security features of the platform
• Use automated tools, bots, or scripts to interact with the platform
• Post spam, unsolicited commercial messages, or malicious content
• Attempt to access another user's account without authorisation
• Violate the intellectual property rights of others

We reserve the right to remove any content and suspend or terminate any account that violates these rules, at our sole discretion and without prior notice.

You retain ownership of content you submit to Flomunis (posts, comments, profile information, etc.). By submitting content, you grant Flomunis a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute that content solely for the purpose of operating and improving the platform.

You are solely responsible for the content you post. You represent that you have the right to submit the content and that it does not violate the rights of any third party or applicable law.

Flomunis may remove any content that violates these Terms or our Community Standards, without notice or liability to you.

Flomunis provides tools to schedule, manage, and record sports matches and events. By participating in matches on the platform:

• You agree to conduct yourself with sportsmanship and respect toward all participants
• You agree to honour scheduled commitments; repeated no-shows may result in account restrictions
• You acknowledge that match results, scores, and rankings submitted through the platform are used to calculate your ranking and leaderboard standing
• Flomunis does not mediate disputes between players; disputed results should be reported through the support channel

Flomunis is not responsible for any injury, property damage, or loss arising from physical participation in matches or events arranged through the platform. You participate at your own risk.

Flomunis offers optional paid Premium tiers (“Premium Individual” and “Premium Organizer”). All payments are processed securely through Stripe. By subscribing:

• You authorise Flomunis to charge the applicable subscription fee on a recurring basis
• Subscriptions renew automatically unless cancelled before the renewal date
• Refunds are not provided for partial subscription periods except where required by applicable law
• You can cancel your subscription at any time from your account settings; access continues until the end of the current billing period

Flomunis reserves the right to change pricing with 30 days' notice to existing subscribers.

By you: You may delete your account at any time from Settings → Account. Deletion is permanent and irreversible.

By Flomunis: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. Suspended users may submit one appeal per suspension through the platform. Termination decisions are final.

Upon termination, your right to access Flomunis ceases immediately. Sections 5, 9, 10, 11, and 12 survive termination.

Flomunis is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.

Flomunis does not endorse, verify, or take responsibility for the accuracy of user-submitted content, match results, or venue information.

To the maximum extent permitted by applicable law, Flomunis Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising from these Terms or your use of Flomunis shall not exceed the greater of (a) CAD $100.00 or (b) the total fees paid by you to Flomunis in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless Flomunis Inc. and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your use of the platform, your violation of these Terms, or your violation of any third-party rights.

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada. You hereby consent to the personal jurisdiction of those courts.

We may update these Terms from time to time to reflect changes to the platform or applicable law. When we make material changes, we will notify you by email and in-app notice at least 14 days before the changes take effect. Existing users will be prompted to re-consent upon next login.

Continued use of Flomunis after the effective date constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the platform and may delete your account.
